1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the KBS Coverage website, platform, software, portals, and related services (collectively, the "Services").

By creating an account, enrolling a device in a Service Plan, submitting a repair or replacement request, accessing dashboards, making payments, or otherwise using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Services.

These Terms apply to all users, including but not limited to parents, students, school administrators, district personnel, technicians, and authorized representatives.

2. Nature of Services

KBS Coverage provides device service administration, repair coordination, logistics support, claims intake processing, technical support, replacement facilitation, and related technology platform services for K-12 schools, districts, parents, and educational organizations.

Services may include:

  • Device enrollment and plan administration;
  • Repair coordination and technician dispatch;
  • Replacement device facilitation;
  • Administrative dashboards and reporting tools;
  • Parent-facing enrollment and payment portals;
  • Shipping coordination and logistics support;
  • Third-party repair vendor management.

KBS Coverage reserves the right to modify, suspend, limit, or discontinue any portion of the Services at any time without liability.

3. Service Plan Disclaimer

KBS Coverage is not an insurance company, insurer, or warranty provider.

THIS AGREEMENT IS NOT AN INSURANCE POLICY, EXTENDED WARRANTY, OR GUARANTEE OF DEVICE PERFORMANCE.

KBS Coverage does not provide indemnification, reimbursement, or cash compensation for damaged, lost, stolen, or malfunctioning devices.

Instead, eligible participants may receive access to discounted repair services, replacement facilitation, logistics coordination, technical support, and administrative services subject to the applicable Service Plan terms, exclusions, limitations, fees, and eligibility requirements.

Participation in a Service Plan does not guarantee approval of any repair, replacement, or service request.

Any repairs, replacements, or services may require payment of service fees, shipping charges, administrative charges, participation fees, or other applicable costs.

KBS Coverage acts solely as a technology platform and service administrator coordinating schools, parents, technicians, logistics providers, and third-party vendors.

4. Eligibility and Accounts

To use the Services, you must be at least 18 years old or have authorization from a parent, guardian, school, or district.

School and district accounts must be created by authorized personnel.

You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.

You agree to notify KBS Coverage immediately of any unauthorized account access or security breach.

KBS reserves the right to suspend, restrict, or terminate accounts suspected of fraud, misuse, abuse, nonpayment, or violation of these Terms.

5. Service Plans and Repair Requests

Participation in a KBS Service Plan may provide access to repair coordination, replacement facilitation, technical assistance, logistics support, and discounted service offerings.

Specific Service Plans may include limitations, service fees, exclusions, incident limits, waiting periods, repair caps, device eligibility restrictions, or participation requirements.

Users submitting repair or replacement requests must provide accurate, complete, and truthful information regarding the device, incident, and account status.

KBS reserves the right to deny, limit, delay, or discontinue services where:

  • Information is inaccurate, misleading, incomplete, or fraudulent;
  • Damage results from intentional acts, abuse, misuse, or unauthorized modifications;
  • Devices are not actively enrolled in an eligible Service Plan;
  • Required fees remain unpaid;
  • Requests fall outside plan limitations or eligibility criteria;
  • Inventory, parts, labor, or replacement availability is limited.

Repair timelines and replacement availability are estimates only and are not guaranteed.

KBS may require photographs, serial numbers, diagnostic reports, school verification, police reports, or physical inspection before approving any service request.

All administrative determinations regarding eligibility and service availability are made at KBS's sole discretion unless otherwise required by law.

6. Payments and Billing

Service Plan fees, participation fees, and other charges are disclosed during enrollment or purchase.

Payments may be charged on an annual, semester, monthly, per-device, or custom billing basis depending on the selected Service Plan.

All fees are non-refundable except where required by law or expressly stated in writing.

Failure to maintain current payment status may result in suspension, cancellation, or lapse of Service Plan participation.

KBS uses third-party payment processors and does not directly store complete payment card information.

By submitting payment information, you authorize KBS and its payment processors to charge your selected payment method for authorized fees and charges.

7. User Conduct

You agree not to:

  • Violate any applicable law or regulation;
  • Submit false, misleading, or fraudulent information;
  • Interfere with or disrupt the Services or related systems;
  • Upload malware, viruses, or harmful code;
  • Attempt unauthorized access to systems or accounts;
  • Abuse, harass, or threaten KBS personnel or vendors;
  • Use the Services for unlawful or unauthorized purposes.

8. Third-Party Vendors and Repair Providers

KBS Coverage may utilize third-party repair facilities, shipping providers, logistics companies, contractors, software providers, and independent technicians.

KBS does not manufacture devices and does not independently guarantee the performance, availability, quality, or timelines of third-party vendors or manufacturers.

Third-party delays, inventory shortages, shipping interruptions, labor shortages, manufacturer limitations, or repair complications may affect service outcomes.

9. Data and Device Responsibility

Users are solely responsible for backing up and securing device data before submitting a device for repair, replacement, inspection, or service.

KBS Coverage is not responsible for data loss, corrupted files, software issues, account lockouts, or loss of personal information resulting from repair or replacement activities.

Users represent that they are authorized owners or authorized custodians of submitted devices.

10. Intellectual Property

All software, trademarks, branding, designs, interfaces, text, graphics, content, and materials associated with the Services are owned by KBS Coverage or its licensors and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services solely for their intended purpose.

You may not reproduce, distribute, modify, reverse engineer, or commercially exploit any portion of the Services without prior written consent.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

KBS COVERAGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE AVAILABILITY.

KBS DOES NOT GUARANTEE THAT SERVICES WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KBS COVERAGE AND ITS OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, VENDORS, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF SCHOOL OPERATIONS, OR BUSINESS INTERRUPTION.

IN NO EVENT SHALL KBS COVERAGE'S TOTAL LIABILITY EXCEED THE TOTAL AMOUNT PAID TO KBS COVERAGE BY THE USER DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME LIMITATIONS MAY NOT APPLY.

13. Indemnification

You agree to indemnify, defend, and hold harmless KBS Coverage and its officers, employees, affiliates, contractors, vendors, and agents from and against all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of:

  • Your use of the Services;
  • Your violation of these Terms;
  • Fraudulent or unlawful conduct;
  • Damage caused to devices, systems, or third parties.

14. Termination

You may stop using the Services at any time.

KBS may suspend, restrict, or terminate access to the Services at any time, with or without notice, for any lawful reason.

Upon termination, your right to use the Services immediately ceases.

Sections intended to survive termination, including limitations of liability, indemnification, dispute resolution, and intellectual property provisions, shall remain in effect.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, excluding conflict-of-law principles.

Before initiating formal proceedings, the parties agree to attempt good-faith informal resolution for at least sixty (60) days.

Any dispute arising from these Terms or the Services shall be resolved through binding arbitration in Austin, Texas under the Commercial Arbitration Rules of the American Arbitration Association.

YOU AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS ACTION, MASS ACTION, OR REPRESENTATIVE PROCEEDING.

16. Force Majeure

KBS Coverage shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, labor disputes, supply shortages, shipping interruptions, internet outages, cyberattacks, governmental actions, pandemics, or vendor failures.

17. Changes to These Terms

KBS Coverage may update these Terms periodically.

Updated Terms become effective upon posting to the website or platform.

Continued use of the Services after updates constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
